Mortgage:
A security right, encumbered on a real estate, for repayment of a debt. The process includes transfers of the title from the borrower to the lender. After the borrower pays off the debt, then the lender will return the title of the property to the borrower.

A legal document by which the owner (i.e., the buyer) transfers to the lender an interest in real estate to secure the repayment of a debt, evidenced by a mortgage note. When the debt is repaid, the mortgage is discharged, and a satisfaction of mortgage is recorded with the register or recorder of deeds in the county where the mortgage was recorded. Because most people cannot afford to buy real estate with cash, nearly every real estate transaction involves a mortgage.

A mortgage is a security interest in real property held by a lender as a security for a debt–usually a loan of money. While a mortgage in itself is not a debt, it is the lender's security for a debt. It is a transfer of an interest in land (or the equivalent) from the owner to the mortgage lender, on the condition that this interest will be returned to the owner when the terms of the mortgage have been satisfied or performed. In other words, the mortgage is a security for the loan that the lender makes to the borrower.

In Indonesia, security right encumbered on real estate / property is regulated by Act #4 year 1996 (Undang-undang no. 4 Tahun 1996 tentang Hak Tanggungan atas Tanah beserta Benda-benda yang berkaitan dengan Tanah), and therefore the right is called "Hak Tanggungan"

Undang-undang no. 4 Tahun 1995 tentang definisi Hak Tanggungan (pasal 1 ayat 1):
Hak Tanggungan atas tanah beserta benda-benda yang berkaitan dengan tanah, yang selanjutnya disebut Hak Tanggungan, adalah hak jaminan yang dibebankan pada hak atas tanah sebagaimana dimaksud dalam Undang- Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria, berikut atau tidak berikut benda- benda lain yang merupakan satu kesatuan dengan tanah itu, untuk pelunasan utang tertentu, yang memberikan kedudukan yang diutamakan kepada kreditor tertentu terhadap kreditor-kreditor lain;

Walaupun demikian, ada perbedaan antara keduanya. Dalam Mortgage, selama hutang belum dilunasi, hak atas Tanah dioper oleh Debitor ke Kreditor, dan Kreditor akan mengembalikan hak tersebut kepada Debitor bila hutang telah lunas. Sedangkan dalam Hak Tanggungan, selama hutang belum lunas, hak atas tanah tetap milik Debitor, dan jika di akhir perjanjian hutang Debitor tidak melunasi hutang, maka hak atas tanah tersebut baru berpindah kepada Kreditor.

Mengingat sifat Hak atas Tanah yang bersifat teritorial dan nasional (subyek hukum berkewarganegaraan asing hanya boleh memegang hak atas tanah yang sudah ditentukan oleh Undang-undang) karena berhubungan dengan kedaulatan wilayah suatu negara, nampaknya hak-hak turunan dari Hak atas Tanah (termasuk hak atas jaminannya) juga tidak akan bisa sembarangan diperdagangkan secara internasional karena adanya pembatasan normatif tersebut.

Jika sifat internasional tetap ada, maka ada kemungkinan Mortgage (yang bukan hak tanggungan) Derivative luar negeri diperdagangkan di Indonesia, dan karenanya istilah Derivatif Hak Tanggungan tidak dapat berlaku secara absolut di Indonesia.

Namun, sifat internasional itu tidak ada, dan oleh karenanya instrumen derivatif yang diperdagangkan di Indonesia hanya terbatas pada obyek berupa Hak Tanggungan. Sekali lagi diperkuat, Mortgage Derivatif = Derivatif Hak Tanggungan.
