But is there much scope for making guesses, i mean sentence clearly reads "may be"

Or you have pasted a hypothetical sentence, if so, then post original sentence to arrive at appropriate conclusion

There are 2 scenarios here. The first one is "XXX is where a person is retaliated against or subjected to a detriment" and the other one is "they may be subject to disciplinary action".

Since your sample sentence contains "may be", hence 'subjected to' shall carry same meaning as of 'subject to'.

Had your sentence contained 'has been' i.e. "He has been subjected to legal and disciplinary action' then it would translate as उस पर विधिक एव अनुशासनात्मक कार्रवाई की गई है or वह विधिक एव अनुशासनात्मक कार्रवाई के विषयाधीन रहा है

But owing to this 'may be', earlier suggestion would fit more appropriately in my opinion
