Stellungnehmer Explanation: Although I am sure about the meaning of this term in English in the context, I am not absolutely sure about the German term (hence CL2). "Einwender" is used in the case of third-party observations, which are generally objections, but that doesn't really work in the case of, say, a patent proprietor filing observations to defend his patent. observer = party that submits/files observations requester = party that requests an opinion Your example is from an OPINION UNDER SECTION 74A See statement at the bottom This opinion is not based on the outcome of fully litigated proceedings. Rather, it is based on whatever material the persons requesting the opinion and filing observations have chosen to put before the Office. Depending on the nature of the request and the party that filed it, the "observer" may be the proprietor of the patent as here https://www.gov.uk/government/uploads/system/uploads/attachm... the representative of the patentee/proprietor as here https://www.gov.uk/government/uploads/system/uploads/attachm... or the possible infringer as here https://www.gov.uk/government/uploads/system/uploads/attachm... See also: The European Patent Convention Article 115 - Observations by third parties In proceedings before the European Patent Office, following the publication of the European patent application, any third party may, in accordance with the Implementing Regulations, present observations concerning the patentability of the invention to which the application or patent relates. That person shall not be a party to the proceedings. http://www.epo.org/law-practice/legal-texts/html/epc/2013/e/... FAQ - Third-party observations I have been trying to file third-party observations using the web form but I get a "please wait" message that remains on the screen and does not allow me to file my comments. What should I do? https://www.epo.org/searching-for-patents/legal/observations... Was soll ich tun? https://www.epo.org/searching-for-patents/legal/observations... |
