Ich übersetze gerade ein Testament aus den USA (New York), darin verfügt der Erblasser u.a.:
"I direct that my Executrix or her substitute shall pay out of my general estate ... all taxes ..., payable by reason of my death in respect to all property included in my estate for the purpose of computing such taxes whether or not such property shall ***pass under or by virtue of this wil***l."
So ganz klar ist mir der letzte Teil nicht. "Pass under" - unterfallen? Und wie verträgt sich das mit by virtue of this will? Das ist ja doch wohl das Gleiche (?).

"Passes under" heißt soviel wie 'eligible' und ist etwas veraltetes 'legalese'. Das wird auch bestätigt durch den weiblichen Ausdruck "Executrix". Heutzutage wird ausschließlich das neutrale "Executor" verwendet. So wollten es die US law firms für die ich früher übersetzt habe.

Tut mir zwar leid, aber meines Erachtens ist nicht unbedingt doppelt-gemoppelt:
Fallkonstellationen / case-scenarios:
1. the Will states: 'all property undisposed of to pass to X': the testator or testatrix T has relatives abroad who, unbeknownst to the latter, have gifted > devised land or bequeathed jewellery in their own Wills to T. The property passes under /im Rahmen von/ but not by virtue of /kraft or gemäß/ T's Will.
2. Likewise, T has 'forgotten' a holiday home: it passes under but not by virtue of the Will as residue.
3. Life policy moneys left to T by the widow/er. The normination of T as beneficiary should pass the monies outside the Will to T as the benficiary but, if T is dead, the proceeds form part of the latter's resdiuary estate passing 'under' and not by virtue of the Will.
4. ausdrückliche Vermächtnisse / gifts > devises of land or legacies of money pass and vest explicitly by virtue and not implicitly / konkludent under or through the Will.

: "Shall pass under or by virtue of this will" ist hier m.M.n. "wird im Rahmen oder kraft dieses Testaments übertragen"/"geht im Rahmen oder kraft dieses Testaments über". Der Doktor sah das m.M.n. schon ganz richtig damals.
