In distinguishing between an employee and an independent contractor, XXXX considers the objective of the contract (or the parties' rights and obligations under the contract).
The objective of the contract is not a mere indicator but determines the legal nature of the contract.
The objective to be established is the pre-eminent objective.
For example, if the object is the surrender of productive capacity (whether capacity to provide a service or to produce things), then the contract is for employment of an employee.

My attempt:
En établissant une distinction entre les employés et les entrepreneurs indépendants ou conseillers, XXXX tient compte de l’objet du contrat (ou des droits et obligations en vertu du contrat).

I found a definition on internet which I dont understand as I am not sure whether "Surrender of Capacity" and "surrender of productive capacity" have the same meaning.
Here is the definition:

"Surrender of Capacity (SoC) is a Congestion Management procedure that allows shippers to return their capacity to XXX (gas transport company). XXX will again offer this capacity at the auction on the PRISMA platform. Capacity returned by shippers will only be sold after XXX has sold its own available capacity."
