Definition

Shift pay is the practice of paying a premium to employees who work the less desirable hours a business must operate. The premium, also called a shift differential, compensates workers who are scheduled for a second or third shift. Some employers pay a shift differential for working weekends, holidays or split shifts. Shift pay consists of a base rate plus the premium. The base rate usually defined as the pay rate the employee would receive for working only daytime hours Monday through Friday.

Regulations

Employers are not legally required to offer shift pay and may pay shift differentials to some workers and not to others. However, some employees work under the terms of collective bargaining agreements that include provisions for shift pay. The main thing an employer needs to be aware of is the application of overtime regulations to shift pay. Under the Fair Labor Standards Act, a shift pay premium is part of an hourly employee’s regular rate and must be included when overtime pay is calculated.

Premium Determination

Employers typically use one of two methods to determine the premium amount to be added to the base rate. If an employer uses a flat rate formula, a specified amount is added to the base rate. For example, you might add $2.50 per hour to the base rate for each worker receiving shift pay. When the percentage method is used, the employee’s base rate is multiplied by a percentage to determine the premium amount. Suppose you select a premium percentage of 25 percent. Joe, who has a base pay rate of $16 per hour, receives a shift differential of $4 plus $16, or $20 per hour. Alice, the shift foreperson, has a base rate of $20 per hour and so gets a premium of $5 for a total of $25 per hour
