Deze voorlopige definitie zal in de volgende paragrafen nader worden gespecificeerd.
Hiermee kiest de Commissie dus voor het model van de Duitse Umlegung, die louter een instrument is voor de herschikking van zakelijke rechten. Ook kiest de Commissie niet voor het Franse model van de AFU. Dat model creëert een verplicht samenwerkingsverband dat enigszins lijkt op de Nederlandse wijkontwikkelingsmaatschappij.
De belangrijkste reden voor deze keuze is dat daarmee zo goed mogelijk aansluiting wordt gezocht bij de WILG - hetgeen ook de opdracht was van de Ministeriële Commissie. Zoals hierna nog zal blijken, is dan ook een vrij eenvoudige vormgeving mogelijk.

De Commissie heeft in eerste instantie gekozen voor een zo scherp en zo letterlijk mogelijke definitie, en wel een die aansluit bij de WILG:
• “Herverkaveling” betekent, in lijn met de WILG (art. 1f, nader uitgewerkt in artikel 42 e.v.), een (privaatrechtelijke) herschikking van de zakelijke rechten op (delen van) de grondpercelen binnen een “blok” (= een op de kadastrale kaart aangegeven, doorgaans aaneengesloten gebied).
• “Stedelijk” betekent: daar waar het bestemmingsplan/omgevingsplan stedelijke functies aan die grondpercelen toekent.
• Hiermee is de afbakening gegeven met de herverkaveling in het kader van de WILG: die vorm van herverkaveling (ook wel: ruilverkaveling) beperkt zich overeenkomstig art. 16 WILG tot het landelijk gebied en de daaraan door het bestemmingsplan/omgevingsplan toegekende landelijke functies.
• In het verlengde hiervan is hiermee ook een afbakening gegeven voor wat betreft het bevoegd gezag: voor herverkaveling op grond van de WILG is dat de provincie, voor Stedelijke Herverkaveling als contramal de gemeente.

with authorities involved in allocation, but if we look at almost all synonyms available, that's the same case. Frank, I love the way you quote a Dutch text to explain this feature of an English word ;) But the E language has been more based on feudal overlordship than the Dutch, and I even feel this authority involvement with parcelling - less so with AmE, but the differences are more to do with WHAT is distributed than BY WHOM (but "redistribution" is also a viable alternative here!). However, let me point out that as regards city areas, it's not very likely that certain bodies/citizens' authorities are involved, not necessarily the municipality, so 'allocation' still hold valid. ((sorry, Frank, what "would need", or what is the object in your " It would need to take ownership in order to re-alocate"? doesn't look like a correct sentence to me))

'(stedelijke) herkaveling' is the exchange of real estate between private parties. 'Reallocation' is used in many contexts, and if you would use it here, it would seem to me that the municipality is involved. It would need to take ownership in order to re-alocate. This is not the case:


'Stedelijke herkaveling zou onder meer het probleem van versnipperd eigendom kunnen oplossen zonder dat het financieel risico van grondbezit bij de overheid wordt gelegd.'

Areas or neighbourhoods can be re-zoned for a different purpose ('een gebied opnieuw inrichten') in order to increase property value, according to the text. This is an administrative procedure and the first step of the process. After that, reparcelling is needed when it comes to 'percelen en gebouwen ruilen'. This involves the municipal cadastral offices in order to reparcel or exchange the plots. Hence my suggestion 'urban reparcelling'.

OK, guys, but. I'm just reading ahead in the section of this document I'm working on, and what they seem to be suggesting as a solution to the vacancy rates issue is that shops currently located on the outskirts of town are brought into the centre, and new uses are found for the now-vacant properties on the periphery. Isn't that *rezoning*, though? Isn't "reparcelling" essentially "this piece of land used to be 2 plots, but now it's 4" (or the other way around or whatever)?
