agree  writeaway: well, good ol' Jurlex doesn't list this but the Dutch ref I found sure does confirm it. And yes, it's definitely a standard fixed phrase in English. But the trick is to show that it's also the correct translation

Verzekeringsrecht: merkelijke schuld, objectieve maatstaf
In de wet is geregeld dat schade door merkelijke schuld van een verzekeringnemer van polisdekking is uitgesloten. Uit een uitspraak van de Hoge Raad blijkt dat onder merkelijke schuld dient te worden verstaan: een 'ernstige mate van schuld'.
Binnenkort wordt de huidige verzekeringsrechtelijke wetgeving vernieuwd. In het wetsvoorstel is de uitdrukking merkelijke schuld aanvankelijk vervangen door de uitdrukking 'grove schuld'. Volgens de Hoge Raad grenst grove schuld in laakbaarheid aan opzet. In de nieuwe wet is dus een hogere mate van schuld vereist dan onder het huidige schuldcriterium.
