In addition, the health ministry announced in its Voorhangbrief keten-dbc’s en huisartsenbekostiging (Preliminary parliamentary scrutiny information on integrated health care schemes and general practice funding; VWS, 2009) that it was commissioning the NZa to produce a monitoring report by late 2011 on the effects of bundled payments.

As outlined above, there are laws and underlying regulations like Governmental Decrees that require a vote in Parliament. In addition, there are other Ministerial regulations, the preparation of which is delegated to a minister. These regulations are not submitted to Parliament for a vote. However, a so-called ‘preliminary scrutiny procedure’ is employed for Ministerial Decrees whereby Parliament is offered an additional opportunity for exercising control.

As described above, the Dutch CG Code is designated by way of an order in council (algemene maatregel van bestuur), as a code of conduct under section 2:391, paragraph five, of the Dutch Civil Code. The order in council refers explicitly to the 2008 Dutch CG Code. This means that every time the Dutch CG Code is amended, a new order in council needs to be adopted.

The procedure for adoption is as follows:
- preparation of a draft order in council by the Ministry of Justice;
- discussions of the draft order in the cabinet (ministerraad);
- submission of the draft to the Upper Chamber (Eerste Kamer) and the Lower Chamber (Tweede Kamer) (this is the so-called ‘preliminary scrutiny procedure’ (voorhangprocedure) during which both the Upper Chamber and the Lower Chamber have four weeks to propose amendments to the draft);
- submission of the draft to the Council of State (Raad van State) for advice; and
- publication of the order in council in the Bulletin of Acts and Decrees (Staatsblad)

By letter dated 16 March 2016 this draft decree was presented to parliament in accordance with the preliminary scrutiny procedure prescribed by law in Article 21.6(4) of the Environmental Management Act [Wet milieubeheer].

@Ghislaine: 'preliminary scrutiny' and 'letter' seem absolutely fine to me in this context, but I'm not entirely sure about the 'proposal' part. Can't think of a better alternative right now, however :-).

agree  Michael Beijer: indeed, these letters seem to often involve/contain legislative proposals/wetsvoorstellen, but are not necessarily proposals themselves.

  -> Thanks, Michael. My thoughts exactly. As far as I can see, submission of the relevant draft order in council for parliamentary scrutiny is required by law in most - if not all - cases.
