Uit het arrest Grossmann Air Services (HvJ EG 12 februari 2004, zaak C-230/02) volgt dat van belanghebbenden in een aanbestedingsprocedure een pro-actieve houding mag worden verwacht. Inschrijvers moeten eventuele onvolkomenheden of onduidelijkheden in de aanbestedingsdocumenten melden in een stadium waarin deze nog ongedaan kunnen worden gemaakt. Doen zij dit niet, dan kan er sprake zijn van rechtsverwerking.

  -> You could argue CJEU is more obvious here, since the source uses HJEG and CJEU certainly is a correct option.
