Bus/Financial - Finance (general) / investment fund prospectus
Catalan term or phrase: la contrapartida incompleixi

is it "balancing item" and "fulfilled" - ie "balancing item not being fulfilled??"

Many thanks

such as failure/default by the counterparty
Explanation:
The counterparty is the "other party" in any financial transaction.

Basically it's saying that the Fund uses derivatives outside the organised markets and therefore "counterparty risk" exists as there is no clearing house to support the Fund if there is a breach by the counterparty.

non-fulfillment / non-performance of the counterparty

Explanation:
"The Fund shall also use derivative financial instruments not used in
organised markets with the objective of hedging, according to the
Regulations in force and only for those investments that are authorised.
This also entails additional risks, like the non-fulfilment of the counterparty, due to the lack of a compensation chamber between the parties that would ensure a positive result in operations."

This translation is not perfect (for example, "càmara de compensació" should be "clearing house", but it should help.

Actually, I agree with Andy on the preposition: it should be 'by' and not 'of'
