Problem: Fact is, translators don't have a perfect legal awareness. They are not lawyers. And not all lawyers are conversant with confidentiality/NDA/data protection rules, which are a system unto themselves, with an abundant 'acquis' in the form of regulations, jurisprudence etc. In this light, translators might comply with information requests from job givers without giving them a second thought. Or they may think a job giver with a good track record would not require anything that's potentially illegal to do.

Solution: Please provide an ample, clear and easily noticeable reminder to translators about confidentiality obligations and confidentiality laws. Please require job givers to exercise temperance and reasonability in their requests, and abstain from requiring anything for which the requiree would need special consents. At least force them to include reminders such as: 'Before you give us this information you should consult your clients and secure the appropriate consents'.

Personal data protection may apply, by the way, in which case it might be required that such job givers sign appropriate commitments prior to receiving that information in order that the translator may avoid incurring liability.
