Dutch to English Bus/Financial Law: Contract(s) Terms and conditions
I've posted this phrase because it forms the most difficult (for me) part of a clause in a set of terms and conditions and I am struggling to formulate it into the English translation. Hence: HELP!!

The clause reads:

Voor zoveel verkoper ten tijde van het intreden van overmacht inmiddels gedeeltelijk zijn verplichtingen uit de overeenkomst is nagekomen of deze zal kunnen nakomen, en aan het nagekomen respectievelijk na te komen gedeelte zelfstandige waarde toekomt, is verkoper gerechtigd om het reeds nagekomen respectievelijk na te komen gedeelte separaat te factureren.

intrinsic - or added - value? Don't know if this helps: The passage seems deal with a situation in which the seller has obligations with regard to the goods being sold (e.g,. maintenance) which, if performed before (or during) delivery to the buyer and if resulting in value being added to the goods, will give rise to the right to be compensated for that added value (in addition to the agreed sale price). An increase, therefore, in the 'intrinsic value' of the goods?

A literal translation will hopefully help you make sense of it:

[…] seller [...] has fulfilled part of his obligations or will be able to fulfil them, and insofar as the part [of the obligations] already fulfilled or yet to be fulfilled has independent value, seller shall be entitled to submit separate invoices for those parts.

Not intended as a translation - merely to give you the general idea.

I can see why you posted this - I'm not clear what is meant by "is nagekomen of deze zal kunnen nakomen." From the context, I think it might mean"has already carried out all or part of the work".

So really your question should read "aan het nagekomen respectievelijk na te komen gedeelte", not "zelfstandige waarde toekomt"

Apologies - I didn't make myself clear enough. I've translated the clause up to the subordinate clause where the phrase is and I don't know how to include it in a way which makes sense. It's this bit: en aan het nagekomen respectievelijk na te komen gedeelte zelfstandige waarde toekomt,

In that case, I don't really understand what you're asking. Are you asking us to translate the entire clause?
